Książka stanowi wprowadzenie do teorii prawa umów. Zawiera omówienie filozoficznych podstaw tej dziedziny prawa w celu ich zrozumienia i uzasadnienia. Istota tych zagadnień została sprowadzona do ontologicznego pytania o naturę umów, normatywnego pytania o racje dla ich mocy wiążącej oraz instytucjonalnego pytania o kształt, jaki powinny przyjąć regulacje prawne dotyczące umów. Adekwatna teoria prawa umów powinna udzielać satysfakcjonujących odpowiedzi na te wszystkie trzy pytania. Znaczna część publikacji jest poświęcona analizie współczesnych teorii prawa umów. Na podstawie wartości, do jakich się odwołują, wyróżniono teorie oparte na autonomii woli, teorie ekonomiczne oraz teorie sprawiedliwościowe. Posiadają one swoje mocne i słabe strony, przy czym podstawową wadą łączącą wszystkie grupy teorii jest ich niekompletność, wynikająca z nacisku położonego tylko na jedno z trzech pytań teorii prawa umów. W monografii podjęto więc próbę sformułowania zintegrowanej teorii prawa umów, która łączy zalety teorii opartych na autonomii, teorii ekonomicznych i teorii sprawiedliwościowych, bez powielania ich niedoskonałości.
