Problem zakresu regulacji ustawowej nietypowych form zarobkowania na przykładzie zatrudnienia zewnętrznego i pracy platformowej

The monograph summarises the 7th national scientific conference in the series ‘Atypical Employment Relationships’, organised on the initiative of Prof. Tomasz Duraj, PhD, of the University of Łódź, on 6 December 2024 at the Faculty of Law and Administration of the University of Łódź by the Scientific Centre for Atypical Employment Relationships (cnsz@wpia.uni.lodz.pl), as well as the Student Forum for Atypical Employment Relationships at the Faculty of Law and Administration of the University of Łódź and the Regional Labour Inspectorate in Łódź.

In Poland, we have been dealing with the phenomenon of the spread of atypical forms of gainful employment in the market economy for a long time. This raises the question of the need to introduce new statutory regulations that will civilise their functioning. Using the example of external employment and platform work, the authors of the monograph consider whether and to what extent this work should be regulated so that, on the one hand, it is performed in accordance with applicable law, guaranteeing contractors an appropriate standard of protection that takes into account international law and the Polish Constitution, and, on the other hand, so that it does not lose its flexibility and competitiveness. Excessive regulation of atypical forms of gainful employment is counterproductive and may lead to their elimination or marginalisation, which will have a negative impact on the labour market and contribute to an increase in unemployment, illegal employment and the grey economy. The study is supplemented by chapters presenting a broader context of the analysed issues, referring to such matters as the impact of digitalisation on the development of new forms of work or the axiological foundations of labour law in the era of algorithmic technologies. The multidimensionality, multi-threaded nature and complexity of the issues addressed encourage readers to explore this monograph.
